2. Platform Role and Service Description
Technology Platform Only
HouseBlue is purely a technology platform. We provide software tools and services that enable property buyers and sellers to connect and conduct business directly with each other. We are:
- NOT a licensed estate agent or property broker
- NOT a party to any property transactions
- NOT involved in negotiations, contracts, or legal aspects of property sales
- NOT providing legal, financial, or professional property advice
Platform Services
Our technology platform enables:
- Property valuations and listings (automated estimates only)
- Direct communication between buyers and sellers
- Appointment scheduling for property viewings
- Digital tools for transaction management
- Offer management and negotiation tools
User-to-User Transactions
All property transactions are directly between buyers and sellers. HouseBlue simply provides the technology platform to facilitate these connections. Users are strongly advised to:
- Seek independent legal advice from qualified solicitors
- Obtain professional property surveys and valuations
- Verify all information independently
- Use qualified professionals for all legal and financial aspects
Solicitor Responsibilities
It is the duty of each party's solicitor to:
- Verify the identity of their client and all parties to the transaction
- Conduct all required Anti-Money Laundering (AML) checks and due diligence
- Ensure compliance with all governmental requirements and regulations
- Verify legal title, ownership, and authority to sell
- Conduct all necessary searches and legal investigations
- Ensure all statutory obligations and disclosures are met
HouseBlue does not conduct any identity verification, AML checks, or governmental compliance procedures. These are the exclusive responsibility of qualified legal professionals engaged by each party.
3. User Accounts and Eligibility
Eligibility
To use our Service, you must:
- Be at least 18 years of age
- Have legal capacity to enter into binding agreements
- Provide accurate and complete registration information
- Comply with all applicable laws and regulations
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Property Listings and Information
Seller Responsibilities
As a property seller, you warrant that:
- You have legal authority to sell the property
- All property information provided is accurate and complete
- Property photos and descriptions are truthful
- You will respond promptly to legitimate buyer inquiries
- You comply with all applicable property disclosure laws
Property Valuations
Our automated valuations are estimates only and should not be relied upon as formal appraisals. We recommend obtaining professional valuations for important decisions.
5. Fees and Payments
Service Fees
HouseBlue operates on a token-based pricing system. You purchase tokens to access our services:
- Property Listing Token: £300 per token
- Each token allows you to list 1 property on Rightmove
- Includes all seller services (photos, descriptions, buyer management, etc.)
- Payment is required before your property listing goes live
Payment Terms
All payments are processed securely through Stripe. Tokens are non-refundable once services have been provided or your property listing goes live. You agree to pay all applicable taxes.
6. User Conduct
You agree not to:
- Provide false, misleading, or fraudulent information
- Use the platform for illegal activities
- Harass, abuse, or harm other users
- Attempt to circumvent our security measures
- Scrape or collect user data without permission
- Interfere with the platform's operation
- Violate any applicable laws or regulations
7. Communications and User Interactions
Our platform provides technology tools for communication between users. You acknowledge and agree that:
- HouseBlue is not a party to any user communications or agreements
- We are not responsible for the content, accuracy, or legality of user communications
- All communications are directly between users - HouseBlue has no involvement
- We may monitor communications for platform safety and quality purposes only
- You should not share personal financial information through our platform
- All property negotiations, contracts, and legal matters are solely between buyer and seller
- You must seek independent legal advice for all property transactions
No Representation or Warranty
HouseBlue makes no representation or warranty about:
- The accuracy of information provided by users
- The reliability or trustworthiness of other users
- The outcome of any property transactions
- The legal validity of any offers, agreements, or contracts between users
8. Disclaimers and Limitations
Property Transaction Disclaimer
IMPORTANT: HouseBlue is not involved in property transactions in any capacity. We:
- Do not verify property ownership, legal title, or seller authority
- Do not conduct due diligence on properties or users
- Do not guarantee the accuracy of property information, photos, or descriptions
- Do not facilitate, oversee, or have any responsibility for property sales contracts
- Do not hold deposits, handle completions, or manage any financial aspects of transactions
Service Availability
We strive to maintain service availability but do not guarantee uninterrupted access. We may suspend services for maintenance, updates, or technical issues without liability.
Third-Party Services
Our platform integrates with third-party services (Stripe, Rightmove, mapping services, etc.). We are not responsible for third-party service performance, policies, or any issues arising from their use.
Limitation of Liability
To the maximum extent permitted by law, HouseBlue is not liable in any way for any claims, damages, losses, or issues arising from your use of our platform or any property transactions facilitated through it.
9. Intellectual Property
The HouseBlue platform, including its design, functionality, and content, is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
10. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
